TERMS & CONDITIONS

1: RESERVATIONS
These require the appropriate deposit, which is non-refundable. Booking requests with deposits will be considered in order of their receipt and, for this purpose, telephoned requests will be noted from the date of the call, provided they are followed by receipt of the appropriate deposit within 10 days. Once the deposit is received we will confirm acceptance in writing and issue a receipt for the deposit. At this point, a contract between the applicant and Lanius Bird Tours comes into existence.

2: PAYMENT
Payment of the balance of the tour cost is due not later than 10 weeks before the departure date. No further reminder will be sent and, if payment is not received by this date, we reserve the right to treat the booking as cancelled. A cancellation fee may be charged at this point to cover costs incurred by the cancellation, the amount of which will not exceed the total cost of the holiday. You are therefore strongly recommended to take out travel insurance at an early stage to cover you in event of cancellation.

3: CANCELLATIONS
In the event of cancellation the deposit is non refundable, however it is transferable (see below) the remaining balance of the tour will be refunded (minus any cancellation fee) as follows.

60 days or more notice 100%
59 – 30 days notice 75%
29 – 8 days notice 50%
7 or less 25%
1 day prior to departure or failure to turn up for the tour no refund will be made. You are therefore strongly advised to take out travel insurance to cover you in event of cancellation.

4: TRANSFERING BOOKINGS
It may be possible for passengers who are unable to proceed with the tour due to sickness or injury of themselves or close family members to transfer bookings to another person, the tour cost plus any additional expenses incurred by the transfer should be settled between the two persons. If the participant cannot find another person to take the place it may be possible for us to fill the place from our waiting list, in this event the tour cost will be refunded minus any additional charges incurred from the transfer.

5: TOUR CANCELLATION
We reserve the right to cancel any tour, for which there are not enough bookings, not less than eight weeks prior to departure. In the event of our cancellation, all deposits and other payments made to Lanius Bird Tours will be refunded in full, or should you choose alternative tours offered.

6: ALTERATIONS
We reserve the right to make any changes to itinerary, travel or holiday arrangements which become necessary after the client makes the booking as long as they do not differ significantly from the original tour plan booked.

7: COST INCREASES
When calculating our tour prices, we try to anticipate the increasing costs of airfares, ground transport and accommodation however should any unexpected increases become apparent we reserve the right to change any of the prices (not less than 60 days before departure) when circumstances arise out of our control e.g. increased exchange rates, charges or taxes, etc.  Should these changes raise the cost of the holiday by more than 10% however, the client has the right to withdraw from the contract and all costs refunded.  The client must inform of their intention to withdraw under this section, in writing, within 14 days of receipt of details of the price increase. Tour cost rises of up to 3% will be absorbed within the original stated price.

8: OUR RESPONSABILITIES
We will take all practical steps to ensure that all services provided are of a satisfactory standard. We cannot, however, accept liability for physical injury, loss, damage or expense resulting from any event that we could not, even with all due care foresee or avoid. Such events may include industrial dispute, natural disaster, adverse weather, fire and all similar events outside our control. Should any additional costs arise as a result of the above the client must pay these. Insurance is therefore absolutely essential.

9: PASSPORT
All participants are responsible for, and must be in possession of, a full passport, valid for at least six months beyond the end of the tour.

10: FINANCIAL PROTECTION
The EC package holiday regulations state that clients must be fully protected from the insolvency of their tour operator.  Lanius Bird Tours is a well-established company who you can travel with in complete confidence.  Your money is protected in two ways:

1. All advance payments are deposited in a trustee account and withdrawals can only be made with the consent of both trustees.

2. Flights will be booked through Agricultural Travel Bureau Ltd, also trading as Barfield Travel & Tours ATOL 2230.  Flight bookings are subject to their booking conditions, a copy of which is available on request.  When a flight booking and full payment have been accepted by us, we will issue you with an ATOL receipt, which confirms that the money is held by us on behalf of Barfield Travel.  A contract will then exist between you and Barfield Travel.  

All ground arrangements are the sole responsibility of Lanius Bird Tours and are provided under a separate contract from the flight arrangements.

11: INSURANCE
Adequate travel insurance is essential and we will insist that suitable cover be arranged for all destinations outside the UK. This should ensure that the necessary protection is provided against loss of deposit and medical costs, which can be enormous, should you become ill or injured during the tour. Please note that travel insurance rarely provides satisfactory cover for expensive optical equipment; you are therefore recommended to seek advice on this when choosing your policy. Proof of travel insurance cover will be needed prior to departure. It is also advisable to carry a European Health Insurance Card (EHIC) with you at all times, the EHIC has now replaced the E111, visit www.ehicard.org for more information about this card.

12: GROUP SIZES
The maximum group size is usually 9, including 2 leaders, this is to ensure the very highest level of guidance at all times and by keeping group sizes small allows for a friendlier atmosphere within the group. On occasions group sizes may be higher but would never exceed 12 plus leaders.

13: ERRORS AND OMISSIONS
Whilst the greatest care is taken in the preparation of our brochure / web site, mistakes can occur. Unless the error or omission has a major effect on the tour no claim for compensation can be entertained.
